Plaintiff was kept in highly unsanitary conditions with poor food and was assaulting, including stabbed, by fellow inmates during his time at Riker's. Plaintiff was compelled to return to court 36 times to defend against the false charges, each time requiring his day to start at 4:00 a.m., to be led and kept in handcuffs throughout the day shackled to fellow inmates, fed only once, and without access to a private bathroom. Plaintiff was acquitted on or about August 14, 2015. On November 11, 2013, shortly before 3:45pm, Plaintiff was with his friend going from Plaintiff's home at 40 Madison Street to play basketball at a park one block away.  Near 46 Madison Street, Plaintiff's friend went across the street and left Plaintiff waiting for him on the sidewalk.  Shortly thereafter Defendant NYPD Officer Arias approached Plaintiff and placed him under arrest for selling a controlled substance.  On November 12, 2013, Plaintiff was charged in criminal court with two felonies (selling a controlled substance) and a misdemeanor (criminal facilitation).  The felony complaint against Plaintiff states that Defendant Officer Arias was informed by the Defendant undercover NYPD officers (Shield #228 & Shield #276) that Defendant Officer Shield #276 purchased crack cocaine from Plaintiff's friend at 46 Madison Street.  The complaint confirmed that Plaintiff was across the street at the time.  Defendant Officer Shield #228 stated that he observed Plaintiff with his friend across the street prior to the alleged drug sale and saw Plaintiff make a \"cut signal\" toward his friend after he crossed the street.  Plaintiff was released on his own recognizance.  On November 15, 2013, Plaintiff testified before the Grand Jury, which returned a vote of no affirmative action.  Plaintiff subsequently testified before the Grand Jury a second time, and on April 18, 2014, the Grand Jury voted to dismiss the felony counts in the indictment.  On May 11, 2014, the People's speedy trial time expired.
