The unknown man was joined by a second. Plaintiff, now understanding the individuals to be undercover POs, asked why the group was being stopped. An individual now believed to be PO McKnight responded the group was stopped due to an ongoing police investigation. However, it is likely the group was stopped because they were African American, a pattern of practice at the NYPD. \n\nThe POs began frisking Plaintiff and her group without legal justification. PO McKnight then placed the group in handcuffs and brought Plaintiff to the 41st Precinct where she was searched again. No contraband was found. Plaintiff asked what she was being charged with but was not told, and spent approximately 4 hours handcuffed to a wooden bench in a cold room without the ability to move. Hours later, PO McKnight informed Plaintiff he found a firearm and she would have to wait for the \"cops with suits.\" Plaintiff had just started a new job and requested a phone call to give notice of her absence to her employer, which she was denied. \n\nPlaintiff then informed PO McKnight that she was pregnant, in pain, and in urgent need of the restroom. After Plaintiff was forced to yell for attention, PO McKnight--a male--escorted her to the restroom and remained, observing, as Plaintiff used the restroom. Plaintiff then urged POs to take her to the emergency room due to her pregnancy pain. POs told her to wait. Plaintiff was released on or about May 8, 2020 without any charges. POs unlawfully questioned Plaintiffs instead of other non-Hispanic males seated in their vehicles at the same approximate time and place as Plaintiffs. POs ordered Plaintiffs to exit the vehicle without reasonable suspicion or probable cause. Plaintiffs exited and Plaintiff Parrilla asked POs why he was being detained. POs refused to answer and instead falsely arrested and handcuffed Plaintiffs. Plaintiff Parrilla's handcuffs were placed too tightly. Plaintiff Parilla asked again why he was being detained and handcuffed. In response POs, including McKnight and Vasquez, committed multiple assaults and batteries to Plaintiff Parilla, including but not limited to tasering him 2 to 3 times then punching and kicking him. Plaintiff Rosario, witnessing the police brutality and excessive force, left the scene of the arrest in fear he would also become a victim of POs' abuses. Plaintiff Rosario turned himself in to the 48th Precinct on October 25, 2019 (per the complaint; likely instead October 25, 2016). \n\nPOs, including McKnight and Vasquez, caused a malicious prosecution to be undertaken against Plaintiffs in order to compel Plaintiffs to provide information regarding other crimes, to conceal their error in allowing Plaintiff Rosario to escape, and to conceal their egregious violations of police procedure. Plaintiff Parrilla was detained for approximately 2 months until all charges except Disorderly Conduct were summarily dismissed on December 21, 2016. Plaintiff Rosario's charges were dismissed on May 15, 2018.
