Plaintiff occasionally video recorded officers who harassed the stand workers, including Defendant Officer James Moran.  This led to confrontations between Defendant Officer Moran and Plaintiff.  Plaintiff was filming Defendant Moran that day when Defendant Moran approached the cart, asked him to step out as he was going to be arrested pursuant to a warrant. Plaintiff shut off his phone and stepped out of the cart.  Defendant Moran then slammed Plaintiff’s head against the cart, handcuffed him tightly and transported him to the precinct.  While at the precinct Plaintiff felt dizzy and asked for water, but that was refused and he subsequently passed out and was treated for high blood pressure.  Defendant officers discouraged Plaintiff from going to the hospital as it would delay his release.  Plaintiff was taken to another precinct for a few hours before being transported to central booking, where he was finally arraigned the following day.  \n\nAt arraignment a warrant from 2002 was raised and adjourned as Plaintiff had previously appeared in court and it was supposed to be dismissed.  Plaintiff was charged with obstructing government administration and resisting arrest.  After three court appearances, these charges were dismissed on March 21, 2013.  in the Second Degree (N.Y.P.L § 195.05) and Resisting Arrest (N.Y.P.L. 205.30). 55.
