Plaintiff was in a verbal dispute with Defendant, a traffic safety agent who was issuing Plaintiff’s car a parking ticket. Plaintiff took the ticket and left the scene. Defendants came to Plaintiff’s apartment, into which they illegally entered without consent or warrant. Defendants punched, kicked, slammed, assaulted and battered Plaintiff inside how own apartment. Defendants conducted an illegal search of Plaintiff’s pockets and patting him down all over. Defendants violently contorted Plaintiff’s arms behind his back in order to handcuff him. Plaintiff repeatedly requested that Defendants loosen the handcuffs, because they were causing him substantial pain and discomfort due to their excessive tightness. Defendants ignored all of Plaintiff’s pleas to loosen the handcuffs, resulting in Plaintiff’s wrists sustaining contusions, swelling, and loss of feeling. Defendants took Plaintiff to the 46th precinct where he was fingerprinted, photographed, searched and confined to a cell. Plaintiff was transported to Central Booking until his arraignment. Defendant signed a criminal complaint against Plaintiff, knowingly affirmed the truth of the fabricated allegations against Plaintiff. Defendant made false allegations to other Defendants because he did not like Plaintiff’s tone when Plaintiff disputed the grounds Defendant had for writing the parking ticket.
