The Defendant police officers provided the District Attorney with misleading and incomplete information alleging that Plaintiff violated the New York City Administrative Code. A prosecution was initiated against Plaintiff for violating the Administrative Code - Unreasonable Noise from a Vehicle Horn. Plaintiff was released from custody after approximately 24 hours. On June 2, 2017, all charges against Plaintiff were dismissed and sealed. As a result of the false imprisonment and arrest, Plaintiff lost his job at Empire Merchants warehouse, from which his income was approximately $500 per week. Smith pulled over and P.O.s approached the driver’s side of the car. P.O. Rodney Greenidge reached through the window and grabbed Smith by the shirt with one hand, then started to punch him with the other. Smith screamed for help, which caused Greenidge to hit him more while attempting to pull Smith through the window. Smith continued to scream for help, which caused passerby to stop and shout out Greenidge, who then backed off to allow Smith to unfasten his seat belt before he dragged Smith from the car. By this time, Smith’s shirt was ripped, and he had sustained numerous hits to his face. During this time, P.O. Craig Wright stood by and did not intervene. Later, Sergeant Jessica Gavars responded to the scene but merely stood by and did not stop Greenidge from assaulting Smith. \n\nSmith was handcuffed and taken to the 75th Precinct where he was searched and placed in a holding cell. Greenidge intentionally placed the handcuffs tight enough on Smith to inflict pain; Smith repeatedly requested they be loosened but was ignored or told to shut up. Smith was held for several hours before being taken to bookings division of the criminal court well he was detained without food, drink water, or access to a restroom for an excess of 24 hours. Smith’s charges were ultimately adjourned in contemplation of dismissal. The officers placed Plaintiff in a neck brace and turned him over, so he was face down on the pavement, on a stretcher. Plaintiff remained in a coma for ten days. None of the officers reported the incident. The Plaintiffs, Lori Dejesus (LORI) and Steven Dejesus (STEVEN) are married. Plaintiff Lori's mother and aunt took over a first floor apartment in Brooklyn before Lori's grandmother died. The Plaintiffs moved into the apartment on October 15, 2012 pursuant to a signed rental lease agreement with Lori's mother. The lease included the first floor apartment, basement, garage and backyard. Lori's aunt and uncle, Doris and Walwyn Stuart, lived in the second floor apartment. Doris passed away in October 2012. Walwyn passed away in June 2013. \n\nOn the day the Plaintiffs moved in, Deidre Dilbert (daughter of Doris and Walwyn; cousin of Lori) and her boyfriend broke into the apartment and harassed the plaintiffs. On December 12, 2012, Plaintiff Lori obtained a temporary order of protection against Deidre Dilbert. That order was violated on December 15 and 17th, resulting in Deidre Dilbert's arrest. \n\nOn January 31, 2013, Deidre Dilbert's brother, Edwyn Stuart (cousin of Lori and NYPD officer) knocked on Lori's door and entered the premises with NYPD officers without invitation. The Edwyn Stuart accused the Plaintiffs of being squatters and thieves. \n\nOn February 4, 2013 Edwyn Stuart returned with Detective Douglas Connors (Shield # 2106) and two unidentified detectives. Plaintiff Loriwas arrested for possession of stolen property. Plaintiff Lori was held in custody for approximately 24 hours. While she was in custody, her mother and Plaintiff Steven were barred entry to their home. On February 6, 2013, a police car parked outside the apartment for half an hour. On February 7, 2013, Plaintiff Lori obtained a temporary protection order against Edwyn Stuart. NYPD Sergeant Salmon (Shield #2836) and six other officers refused to serve the order on Edwyn Stuart. On February 8, 2013, P.O. Enks called Plaintiff Lori and abusively demanded that she drop the report against Deidre Dilbert. \n\nOn March 7, 2013, NYPD Police Officers Lee and Jordan attended the Plaintiff's home and brought them against their will to the precinct. They were kept there for 6 hours before being released with without charges. On March 9, 2013 an unidentiied plainclothes officer repeatedly rang the Plaintiffs doorbell and sat in his car outside the house for several hours. \n\nOn March 11, 2013 Edwyn Stuart and 12 Emergency Service Unit officers attended the Plaintiff's home with a battering ram. Plaintiff Lori was again arrested, handcuffedand held in a precinct cell for eight (8) hours. A female officer told Plaintiff Lori that \"Edwyn has a lot of friends here\".
