Northstar Mitsubishi) located at 46-05 Northern Blvd in Queens, NY, Plaintiff Jared Koon returned to the dealership and requested a refund of his $2500 purchase price. According to the terms of his purchase agreement, Plaintiff Koon was entitled to a refund within 30 days of purchase. The vehicle, which was advertised as being in \"mint\" condition, exhibited multiple defects, including moving in reverse when the car was in drive. Following a brief 10 minute inspection, the salespersons at the dealership insisted that the car was in \"perfect\" operating condition and refused to give Plaintiff his refund. When Plaintiff then refused to leave, the salespersons called the police and reported Plaintiff as a trespasser. Upon arrival, NYPD Officers RACHEL DAVIDOV, and VINCENT CERRETA told Plaintiff that he had to leave and when Plaintiff refused, the Defendant officers called for backup. When five more officers arrived, without provocation, the Defendant officers grabbed the Plaintiff, lifted him and then slammed him to the ground. Plaintiff suffered multiple lacerations and contusions to his face and a fractured tooth. The officers then falsely claimed that Plaintiff had resisted arrest and arrested Plaintiff who was incarcerated for 24 hours before his release on July 12.
