Several Police Officers including defendant Police Officer Christopher McLaughlin, Tax / Shield No. 8960, and defendant Sergeant Russell Maturo, Tax / Shield No. 02822, approached Plaintiff. Without any explanation, the officers grabbed Plaintiff, forced him into handcuffs, and used excessive force to throw him to the ground and beat him. The officers then unlawfully searched Plaintiff and recovered no contraband from Plaintiff. Despite having no probable cause to believe that Plaintiff had committed any crimes or offenses, defendant officers placed Plaintiff into handcuffs and under arrest, and subsequently transported Plaintiff to the police precinct. At the precinct, Plaintiff was searched, processed and placed into a holding cell. Plaintiff later learned that he was charged with obstructing governmental administration, resisting arrest, aggressive panhandling, and disorderly conduct. \n\nFrom the precinct, Plaintiff was transported to New York County Central Booking, and was subsequently arraigned. Plaintiff was released after spending in excess of twenty-four (24) hours in custody, and upon release, Plaintiff received medical treatment for the injuries that he sustained as a result of the defendant officers’ use of excessive force.
