When Plaintiff refused to leave the apartment, his wife called 911. When the defendant officers arrived, they lacked any basis to order plaintiff to leave his apartment because he had not committed any crime. Nevertheless, the police officers falsely told Plaintiff that there was an outstanding order of protection that stated he had to stay away from his wife, and he was in violation of the order of protection. The defendant officers unlawfully handcuffed Plaintiff and arrested him without any legal justification, transporting him to the police precinct. At the precinct, the defendant officers falsely stated to the DA’s Office that Plaintiff had committed a crime and violated an order of protection, even though the officers knew that there was not an active order of protection for plaintiff. In fact, the alleged active order of protection that the defendant officers falsely alleged existed was actually for a different individual under a completely unrelated docket number. Plaintiff was then transported to Central Booking where he was detained for many hours.
