POs, including PO Hensley Caraballo, unlawfully approached Plaintiff, violently grabbed him, forcefully pushed him, and slammed him into the ground, seriously injuring Plaintiff's knees. At no point did Plaintiff refuse compliance with the POs' unlawful orders, and neither did he curse or yell. POs were motivated to attack Plaintiff solely by virtue of Plaintiff's race. POs, including PO Caraballo, continued to assault Plaintiff, including violently punching Plaintiff's ribs and placing their knees on Plaintiff's back for approximately 10 minutes. POs, including PO Caraballo, the illegally placed handcuffs on Plaintiff and dragged him to a police car while continuing to subject Plaintiff to excessive force, including violently hitting Plaintiff's ribs and back without justification. \n\nPlaintiff was taken to the 44th Precinct where he requested medical attention. POs, including PO Carabello, denied the requests. Throughout the unlawful arrest and detainment, POs repeatedly disparaged Plaintiff's immigration status and race, exposing POs' true motive and intent behind their illegal actions. Plaintiff was held for approximately 6 hours before his release, at which time he went to hospital for treatment of his injuries.
