After detaining the Plaintiff and her boyfriend the police officers broke down the padlocked door to the middle bedroom of the apartment and found a weapon in a closet, drugs and drug paraphernalia hidden in a drawer.  This middle bedroom was at all times under the exclusive control of Jeffrey Timmons. Plaintiff was arrested and charged with 1) criminal sale of a controlled substance in the second degree, 2) criminal possession of a controlled substance in the third degree, 3) criminal possession of a weapon in the second degree, 4) Criminal possession of a controlled substance in the seventh degree,  and 5) Criminally using drug paraphernalia in the second degree.  Plaintiff was arrested and during her interrogation by the police officers she was informed that they knew she had nothing to do with the weapons and drugs and would be released if she provided information about her boyfriend.  Plaintiff was also informed that if she refused to cooperate she would be incarcerated and they would release her when she gave information tying the weapons and drugs to her boyfriend.  Plaintiff was imprisoned at Rikers Island for 7 weeks and made several court appearance in Criminal court.
