At no time did Plaintiff commit any crime, break any law, or behave in a manner that would lead a reasonable person to believe Plaintiff committed a crime. The Defendant Police Officers, including Defendant Dennis, approached Plaintiff as he was standing on the upper platform of the station and stopped, questioned, frisked, and unlawfully detained Plaintiff. After approximately 3 minutes, the Defendant police officers falsely arrested Plaintiff and handcuffed him. Plaintiff was transported by foot to the transit district police precinct located inside the subway station. Plaintiff was unlawfully searched at the police precinct and unlawfully detained in a holding cell for many hours. \n\nDefendant police officers forward false, misleading, fabricated, and incomplete information about the factual allegations that formed their basis for arresting Plaintiff to the DA's office, namely that they had witnessed Plaintiff forcibly touch a female passenger on the train, and she had complained to the officers. The female passenger testified under oath that she never accused Plaintiff of sexually touching her on the train and was approached by police officers who suggested to her that someone on the train sexually touched her. Plaintiff was arraigned on false charges, requiring him to appear in court on numerous dates for six months.
