One of the officers stomped Plaintiff with his boots while he lay defenseless on the ground, leading him to bleed profusely from his mouth, chin, and right ear. Plaintiff was arrested, placed in a squad car, and transported to the 77th Police Precinct. While in the car, Plaintiff could hear messages being relayed that the robbery suspect had blonde hair; Plaintiff did not have blonde hair.\n\nUpon arrival at the precinct and following his requests, Plaintiff was taken to a hospital where he was treated for his injuries. After being released into police custody, Plaintiff was taken back to the precinct and then to central booking. On June 3, 2014, at approximately 11:00 p.m., Plaintiff was arraigned in front of a judge and charged with several crimes. The criminal complaint was signed under oath by Officer Viera and was a complete fabrication. Plaintiff plead “not guilty” and was ROR’ed.
