Plaintiff tried to defend himself with a box knife, but the assailants beat him unconscious and slashed his face. The defendants did not believe the plaintiff was a victim of attempted robbery and instead believed he was the attacker. Because plaintiff was not believed to be a victim, he was unable to seek payment for medical procedures from the Crime Victims Compensation Fund. Further, defendant presented a cross complaint against plaintiff for second degree assault and the case was presented to the grand jury without notice. From the date of the alleged assault incident until his arrest on July 1, 2013, plaintiff received no noticed that he had been indicted and a warrant was out for his arrest.
