Ms. Melendez began to film Sgt. Tavarez and Officer Thomas as they placed her boyfriend under arrest with unnecessary roughness. Tavarez demanded she stop filming, despite not interfering with them in any way, and proceeded to push her into the car, punch her in the face (causing her to briefly lose consciousness),and grab hold of her hair to bang her head into the car. She was then handcuffed and placed in the police car with her boyfriend (Sgt. Sanchez and Lt. Morales arrived at the scene and also contributed to the arrest). Ms. Melendez, in police custody, was taken to the ER where she was informed she had suffered a fractured nose. She was then brought to the precinct and arraigned after 24 hours in custody. She was falsely charged with resisting arrest, obstructing justice, attempted assault, harassment and disorderly conduct - all were eventually dismissed. Officer Thomas wrote the complaint. Sgt. Hockaday approved of the arrest report and as part of an investigation related to the incident, spoliated photos he had taken of alleged injuries to Sgt. Tavarez to cover up misconduct.","documents":[{"url":"https://storage.courtlistener.com/recap/gov.uscourts.nysd.495703/gov.uscourts.nysd.495703.50.0.pdf","type":"complaint"}],"url":"https://www.courtlistener.com/docket/7167826/melendez-v-city-of-new-york/"},{"name":"Green, Troy vs City of New York, et al.","start_date":"2016-07-26","disposition_date":"2017-08-22","payout_amount":0,"disposition":"Zero Disposition","docket":"16CV03872","court":"U.S. District Court - Southern District NY","officer_name":"Sanchez, Miguel A.","summary":"Defendant police officers approached Plaintiff while he was outside his building, inquired about an argument that occurred earlier, then searched plaintiff and his sister, and the surrounding area.
