One of the Defendants handcuffed the Plaintiff and then Defendants Martin, Walsh, Dobrossy, and/or Tiernan placed him in the rear of the police van. Shortly after, the air conditioning was turned off and Defendants drove Plaintiff around for a while in stifling conditions. Defendants Dobrossy and Tiernan transported Plaintiff to the 73rd Precinct where he was imprisoned. While he was imprisoned, a friend of the Plaintiff brought his prescription bottle for Oxycodone to the Precinct and showed it to Defendants Martin, Walsh, and/or Cuozzo. Plaintiff was then transported to Brooklyn Central Booking where he continued to be imprisoned. On May 31, 2012, Defendant Russell signed a Criminal Court complaint accusing Plaintiff of Criminal Possession of a Controlled Substance in the Seventh Degree. Plaintiff was arraigned and released on his own recognizance. Without any legal basis, PO Cuozzo searched Plaintiff, found approximately USD 1,500 on Plaintiff, and stole that money. Plaintiff was finally released on her own recognizance around midnight on June 4, 2013, after being in custody for approximately 30 hours. Plaintiff made several court appearances before all charges were dismissed. \n\nOn January 26, 2011, Plaintiff was in her home when PO Daniel Perez and two other NYPD officers unlawfully entered her apartment and demanded that Plaintiff give them one or more firearms they claimed were in her home. PO Perez informed Plaintiff that he did not have a warrant, but he had Plaintiff’s husband in custody and would release the husband in exchange for firearms. When Plaintiff told PO Perez to leave, he threatened to have Plaintiff removed from her housing. PO Perez also, inter alia, searched the apartment for approximately one hour, before he left empty-handed.
