TBTAP placed N. Garbellotto under arrest for DUI, and she was later revived by the fire department in an ambulance. She was taken to the hospital where a psychiatric emergency protocol was undertaken, placing her in Defendant officers' duty of care to protect her from self harm.\n\nN. Garbellotto's condition continued to deteriorate. Defendant medical staff and officers failed to ensure she did not take more narcotics and did not follow up with tests to check for the benzodiazepines and alcohol noted by medical staff to likely be in her system. She was discharged at 1:45 AM on December 8, 2016. This was an unreasonable discharge given her poor condition. She was the taken to a cell in the 120th Precinct, where she was confined and monitored by Defendant NYPD Officers. Defendants failed to adequately monitor N. Garbellotto, who was found unresponsive in a cell at 11:20 AM and pronounced dead at 12:03 PM. He was handcuffed so tightly that he experienced extreme numbness. The officers kicked his head, neck, legs, and groin area and punched him in the face and head. The Plaintiff yelled to Sumuylin to “Please stop then,” but Sumuylin did not intervene until officer Hansen pointed his weapon at the Plaintiff, at which point he told him to put the gun down and take the Plaintiff to the station. The beating lasted 5-7 minutes. \n\nAt the police station the Plaintiff told Sumuylin and Lafemina that he needed to see a doctor and they each threatened to hurt him more if he reported the assault. At the aforesaid time and place, the defendants, members of the New York City Police Department, unlawfully and without reasonable suspicion or probable cause pulled the plaintiff's vehicle, pulled him out of the car. During the course of this incident, plaintiff DIVAIN DUNDAS was punched, kicked, assaulted and otherwise manhandled by members of the New York City Police Department. The plaintiff was placed under arrest and taken to the 75th Precinct, and subsequently to Central Booking in Kings County, City and State of New York, where he was arraigned on various Vehicle and Traffic Law charges. Plaintiff was held in custody until January 13, 2012 at approximately 7 P.M. on January 13, 2012 when he was released on his own recognizance. Defendants caused plaintiff to be prosecuted until February 23, 2012 when all charges were dismissed after the Grand Jury of Kings County failed to vote out a true bill of indictment.
