While there, Defendant Blackett, a New York City police officer, who was already inside, appeared from behind a door with his pistol drawn and fired point blank at the Plaintiff's face. The Plaintiff was in the face and right eye with fragments from the discharged bullet. The Plaintiff fell to the ground bleeding, unable to see or hear. Defendant Blackett apprehended the Plaintiff while he was on the ground and pulled him into a standing position, then walked him towards some steps. The residents of the location rushed to the room after hearing the gunshot and confronted the defendant but Defendant Blackett pointed his gun at them and held everyone in place. Even though the Plaintiff required medical attention, Defendant Blackett failed to provide or request it. Defendant Blackett ordered someone to call the police and held everyone at gunpoint until Defendant Gourlay and other defendants arrived. \n\nDefendants conspired amongst themselves to falsely accuse the Plaintiff of trespass and robbery. The residents protested the Plaintiffs arrest but were told to be silent. Plaintiff's demands to be taken to a hospital were also denied. Plaintiff was only allowed treatment by an ambulance. This treatment was inadequate and he was placed inside a police vehicle with shrapnel still in his eye. The Plaintiff was driven to the precinct and during the ride demanded to be taken to a hospital. Again he was denied. At the precinct, the Plaintiff was again denied medical attention and he was placed in a holding cell. A 911 call was made by his sister, requesting assistance with an emotionally disturbed individual (Decendent Plaintiff) \nIn response, Police Officer Patrick Gourlay and Police Officer Kurt Fitzcharles  arrived at the scene. Both officers were neither assigned to the Emergency Services Unit nor properly trained to handle situations involving emotionally disturbed persons, as required by NYPD protocols.\n\nUpon arrival, Officer Fitzcharles allegedly deployed a stun gun, striking James Owens, who posed no threat. Following this, Officer Gourlay discharged his stun gun three times and  other conductive energy device, fatally wounding decendent plaintiff.
