Plaintiff, CHRISTOPHER CUEVAS, is a Latino or Hispanic male who was lawfully present and recovering from injuries he sustained in a motor vehicle accident that occurred less than a few hours before in the vicinity of this complained-of-incident. Defendants approached the Plaintiff, with their arms outstretched toward Plaintiff in an overtly aggressive and threatening manner causing Plaintiff to fear for his physical safety and wellbeing. Defendants questioned him and accused him of a criminal offense due to their racially discriminatory prejudices against Latino or Hispanic males.  Defendants arrested Plaintiff and forcibly affixed metal handcuffs to his wrists and metal shackles to his legs in an excessively tight fashion.  Despite Plaintiffs complaints that it was too tight and causing him substantial pain and discomfort the defendants refused to loosen or remove. As a result, Plaintiff suffered lacerations, contusions, hematomas and a diminished range of movement to his arms, wrists and hands and while in custody he required emergency medical attention at St. Barnabas Hospital for treatment and care. Plaintiff also suffered additional injuries by defendants, because they refused to remove/loosen the tight handcuffs and shackles despite Plaintiff suffering from a fractured tibia. \nTwo (2) days later, Plaintiff was transported  to Central Booking by Defendants where he was fingerprinted, photographed, searched, eye-scanned, and detained throughout for approximately twelve (12) hours until his release from physical custody, on or about September 15, 2020.
