Defendant officers unlawfully stopped, questioned, frisked, and falsely arrested Mr. Toledo without probable cause or any legal justification. The day before the relevant incident, two Defendant Officers claimed the child who was transported to the emergency room was a victim of opioid abuse. Ultimately, the medical staff were able to revive the girl and the toxicology reports showed there were no drugs in her system. The following morning, the New York City Administration for Children's Services arrive at Mr. Toledo's home accompanied by defendant officers. It was at this point Mr. Toledo was unlawfully arrested and handcuffed with metal handcuffs. Mr. Toledo was then transported to the 50th Precinct in an NYPD vehicle where he was held in a holding cell. Thereafter, Mr. Toledo was taken to Bronx County Central Booking where the defendant officers provided the District Attorney's Office with false, misleading and/or incomplete information that Mr. toledo committed a crime. On September 8, 2022, Mr. Toledo was arraigned and charged with crimes he did not commit.
