Two Officers, including Defendants Morgan Courgnaud and John Doe, approached the driver, who asked why he was stopped. Officer Courgnaud responded, \"Don't ask me any fucking questions, just give me your ID,\" and he complied. Officer Courgnaud returned to the car, advised the driver that his license was suspended, and asked him to get out of the car. He complied and told Plaintiff that she would have to drive as the Officers took him to the back of the marked police car. Plaintiff walked around the front of the car and sat in the driver's seat with the door fully open and her legs outside the car on the ground. Plaintiff called her uncle, an attorney, because she had never been in a situation before where someone was taken into police custody. Officer Courgnaud approached before she was able to say more than hello to her uncle and asked who she was on the phone with. Plaintiff explained it was her uncle and Officer Courgnaud grabbed the phone from her and threw it into the car. He then pulled Plaintiff out of the car, grabbing her shirt and stating that they were taking the car. Plaintiff explained the car was in her name and registered to her and that she did not understand, to which Officer Courgnaud responded, \"Shut up.\" He then turned her around and forcefully slammed her head into the car in the area of the open door frame, using his hand placed direct onto Plaintiff's head and intentionally forcefully slamming her face into the car, causing the orbital area of her face on the left side to be smashed into the car. Officer Courgnaud then handcuffed Plaintiff, searched by patting her down along the bottom of her bra and up and down her legs, between the inside and outside of her things, and grabbed her by her upper arm. He then walked her to another police car that had arrived. Plaintiff was taken to the 20th precinct. Plaintiff was later taken to Central Booking and then arraigned and sought medical treatment upon her release. On September 28, 2012, Plaintiff appeared in court and turned down an offer for an adjournment in contemplation of dismissal because she was not guilty of any charges. On November 15, 2012, the prosecution was not ready for trial, and the case was adjourned.
