The Plaintiff and the Plaintiff’s significant other communicated to Defendants that they did not require their assistance, that the allegations of criminal conduct against Plaintiff were false, and that said defendants should leave the vicinity of this complained-of-incident. Defendants PO CAROSELLA, LANGAN, and others then forced their way into Plaintiff’s residence in a violent fashion by pushing the door back and causing it to come into forceful and immediate contact with Plaintiff’s head before entering inside Plaintiff’s residence without probable cause, reasonable suspicion, consent to enter thereat, valid search or arrest warrant, or any legal justification. The search yielded no evidence of any guns, drugs or contraband. Despite the absence of any evidence of wrongdoing by the plaintiff, the defendants formally arrested the plaintiff and transported him to the 34th precinct, and then he was subsequently moved to the Central Booking Unit where plaintiff was placed in a holding cell until Plaintiff was released from physical custody on or about May 6, 2023, after his arraignment. While Plaintiff was in custody at the precinct, defendant officers prepared and filed false paperwork with the DA charging Plaintiff with possession and sale of narcotics. As a result, Plaintiff was deprived of his liberty over the course of approximately 2 days.
