Before the train stopped, the plaintiff had not been involved in any altercations or violated any laws. The defendants entered the train and ordered the plaintiff to get off without cause. When the plaintiff inquired why, the defendants forcibly grabbed him and his wheelchair, lifting it improperly and breaking the left footrest, causing the plaintiff's left leg to dangle and be twisted painfully. Despite the plaintiff's screams, the defendants dragged him and his wheelchair up the station stairs to the street. The plaintiff informed the defendants of his intent to file a complaint, after which they decided to escort him back to the train instead of seeking medical assistance. The plaintiff traveled home in severe pain. At no time did the plaintiff resist. Defendants who were present but not physically involved failed to intervene.","documents":[{"url":"https://iapps.courts.state.ny.us/nyscef/ViewDocument?docIndex=QmZeGNXvewbwPSECp5jy3Q==","type":"complaint"}]}],"discipline":[{"disposition_date":"2023-11-28","case_no":"2023-29110","penalty":"B - Command Discipline, vacation days (5 days)","recommendation":"Command Discipline - B","allegations":[{"desc":"Wrongfully threatened to remove an individual to the hospital."}]},{"disposition_date":"2023-04-25","case_no":"2020-22219","penalty":"Training","recommendation":"Training","allegations":[{"desc":"Wrongfully acted discourteously towards an individual know to the Department."},{"desc":"Wrongfully acted discourteously towards an individual known to the Department."}]}],"image":"https://www.50-a.org/images/officer/4SUH-charles-powell.jpg","payroll":{"salary":"109352","regular":"108510","overtime":"23152","other":"23236","total":"154898"},"id":"4SUH","url":"https://www.50-a.org/officer/4SUH"}
