At the aforementioned place and time, the Plaintiff was lawfully present at the Electric Zoo Music Festival with his three friends. Plaintiff was sitting with his friends and eating when three of the Defendant Officers surrounded Plaintiff and grabbed him by his arms from the back and ripped him out of his seat. Defendant Officers then put Plaintiffs hands behind his back and put metal handcuffs around Plaintiffs wrists. None of the Defendant Officers were in uniform nor did they announce themselves as police officers or present a badge. Defendant Officers then searched through Plaintiff's backpack. At no time relevant herein did Plaintiff commit a crime or violate the law in any way, nor did the police officers have an objective credible reason to believe that Plaintiff was engaged in criminal conduct or had violated the law in any way. At no point did Defendant Officers recover any illegal drugs, weapons, graffiti instruments, or other illegal contraband from Plaintiff's person or from a location that was in Plaintiffs\npossession. Plaintiff did not resist arrest. Nevertheless, without legal\n justification or probable cause Plaintiff was unlawfully arrested. After Plaintiff was escorted out of the vicinity in handcuffs, he was brought to a police vehicle filled with 14 other people. During this time, Plaintiff was sitting on the floor of the van pressed against strangers for five (5) hours without the ability to use the bathroom and was not given any water. During this time Plaintiff was forced to share his metal handcuffs with a stranger during this five (5) hour period. After spending approximately five (5) hours in the police vehicle he was taken to the precinct, where he was fingerprinted, photographed, and placed in a holding cell. The cell Plaintiff was forced into had insufficient space for the amount of people the Defendant Officers fit into it, causing everyone to again be pressed up against one another and be forced to sit on the floor. While Plaintiff was in custody, the Defendant Officers refused to give Plaintiff any food or water for an additional eight (8) hours when they offered leftover pizza that the Defendant Officers previously ate from. During this time Plaintiff had to witness two people threatening to kill each other inside of the cramped cell he was forced into by Defendant Officers. After a total of 13 hours of being held by Defendant Officers, Plaintiff was given a Desk Appearance Ticket and was released. Defendant Officer Douglas Ryan signed a criminal complaint against Plaintiff where they affirmed the false allegations that Plaintiff was criminally in possession of narcotics or other drug-related crimes.
