Detective Kenneth Wieber forced and compelled the plaintiff to be handcuffed and falsely arrested and imprisoned him, thereafter locking up the plaintiff in a holding cell at the police precinct and charging the plaintiff with the crime of Criminal Contempt. The order of protection was invalid, and Detective Wieber knew or should have known that the order was invalid. The Kings County District Attorneys Office informed Detective Wieber that they would not prosecute the matter as no crime had been committed and ordered Detective Wieber to release the plaintiff. The false arrest and imprisonment, unlawful search and seizure, excessive force used in the process, and malicious prosecution caused physical, mental, and financial damage to the plaintiff.
