Plaintiff was issued a ticket for being in the park past curfew hours despite never entering the park. Defendants began mocking Plaintiff and told him they were going to search him, to which Plaintiff replied that he could not afford a ticket and had nothing on him. Defendants grabbed, handcuffed and searched Plaintiff, and discovered no contraband or evidence of wrongdoing. Plaintiff was improperly hoisted into the police van, which resulted in his finger being injured. Plaintiff received medical treatment, and afterwords was fingerprinted, photographed and held overnight before being transferred to central booking where he was charged with obstruction of governmental administration in the 2nd degree, resisting arrest and loitering in a New York City park.
