Video footage shows Plaintiff trying to get up off the ground and avoiding escalating the situation. PO Gloria Cevallos and Minator Kryeziu then arrived at the scene and tried to handcuff Plaintiff while he was still on the ground, without first announcing themselves or asking any questions. A confused Plaintiff attempted to stand up from the sidewalk while PO Cevallos held his arms behind his back. PO Kryeziu then grabbed him, slammed him to the ground, and punched him in the face at least three times. As a result of this unprovoked attack, Plaintiff lost consciousness and his face bled profusely. PO Cevallos and Kryeziu started dragging Plaintiff’s limp body towards a squad car. Four additional PO –Jorge Malavet, Racquel Palmer, and two unknown officers – arrived and joined PO Cevallos and Kryeziu in dragging Plaintiff’s body to the car, causing further injuries. \n\nPlaintiff was wrongfully imprisoned and spent two nights in jail. PO Cevallos fabricated information, based on which Plaintiff arraigned in state and federal court. However, video footage from the incident showed that the charges against Plaintiff were false, and that he had been violently attacked by the officers. On November 3, 2021, the federal charge against Plaintiff was dismissed by consent of the parties.
