Defendant Vila issued plaintiff a Desk Appearance Ticket for marijuana possession, which plaintiff had voluntarily handed over during the encounter. After about an hour, plaintiff was told he could leave if he cleaned himself up. He walked home, two miles away, with a swollen and bleeding right eye. His sister called an ambulance, and he was taken to Jamaica Hospital Medical Center, where a CT scan revealed a fracture of the orbital bone around his right eye.
