When the owner of the property Plaintiff was moving saw police turn toward them he ran to a car and drove away. Det. Michael Michellena and other POs approached Plaintiff, asked regarding the owner of the property, and opened the boxes. POs discovered the boxes contained cartons of cigarettes. Plaintiff was arrested. Plaintiff explained he did not know where the owner went and that he was simply assisting in unloading unknown items but POs ignored him, placed him in handcuffs, and took him to the precinct. Plaintiff was held at the precinct for 48 hours, at which time he was charged with possession or sale of unstamped cigarettes. Plaintiff was compelled to attend court 4 times to defend against the malicious prosecution before the case was ultimately dismissed on October 11, 2013.
