During their investigation, the defendants requested video recordings of the shooting from the NYCHA, but the time frame for which they requested video tapes ended ten minutes before the murder was actually committed; they omitted the moment of the murder, the most relevant and exculpatory part of the video, from their request, knowing that without an NYPD request to preserve it, NYCHA would erase the recording within 21 days. Although the plaintiff Jamel Fielder did not match the physical description of the shooter given to them by a witness, they provided information to the Bronx DA which resulted in the indictment of Mr. Fielder. On June 14, 2018 Mr. Fielder was arrested. The plaintiff alleges that he was arrested and prosecuted in an attempt to force him to provide information about various crimes.
