The driver was an off-duty NYPD officer, Wayne Issacs. When both cars stopped next to each other at a traffic light, the deceased got out of his car and approached Issacs's car. Issacs rolled down his window, pulled out a gun, and shot the deceased three times with his NYPD-required firearm. The plaintiffs were approximately seven feet away, and watched unobstructed as Issacs shot the deceased. Issacs did not attend to the deceased after shooting him, calling a Police Benevolent Association representative before calling 911. EMTS and additional NYPD officers then arrived. These officers intentionally prevented plaintiffs from aiding and comforting the deceased as he lay dying. These officers took plaintiffs to the precinct and conducted interrogations outside the presence of a lawyer and, for a minor plaintiff, outside the presence of her mother and a lawyer. NYPD sources later provided false statements to the media to cover up Issacs's misconduct, alleging that the deceased had attacked him before the shooting.\n\nOn July 8, 2016, the New York Post obtained and released a surveillance video that showed Issacs shooting immediately after the deceased approached his vehicle, contrary to the NYPD's account. Plaintiff requested to be transported to the hospital for medical treatment. Later, EMS personnel arrived at the precinct. Defendant officers stated there was nothing wrong with Plaintiff, and insisted Plaintiff must be evaluated and treated at the precinct and should not be transported to the hospital for medical evaluation. EMS personnel advised defendant officers they could not treat Plaintiff at the precinct and Plaintiff must be transported to the hospital for medical treatment. Afterwards, defendant officers forcibly punched Plaintiff on his right shoulder knocking him down to the floor, with the handcuffs pressed against his back. Defendant officers yanked Plaintiff off the floor grabbing him by his waist and forcibly dragged him to the ambulance. At the ambulance, defendant officers opened the door, forcibly dragged Plaintiff up the stairs and threw Plaintiff inside the ambulance.  Plaintiff sustained serious injuries on various parts of his body as a result of the assault by defendant officers, and was transported to Brookdale Medical Center. After detaining Plaintiff for a lengthy period of time at the hospital and precinct, Plaintiff was transported to Central Booking for arraignment. Defendant officers met with prosecutors employed by the Kings County DA’s Office, and falsely stated to the prosecutors, that Plaintiff committed the charged offenses. Based on defendant's false testimony, a prosecution was commenced against plaintiff. On April 23, 2013, Plaintiff's case was adjourned in contemplation of dismissal. During the raid, the officers, inter alia, pointed guns at Plaintiffs, performed illegal detentions and searches, failed to provide Miranda rights, used excessive force, failed to allow Plaintiffs to put on proper clothes before they were taken outside, and unlawfully arrested several of the Plaintiffs. Once all residents had been removed from the premises, officers, without consent or a warrant, conducted a full search of the premises that went on for several hours. Later, after returning to the premises, the Plaintiffs found that the premises was severely damaged and that their personal property was missing and/or broken. At the time the complaint was filed, one of the Plaintiffs had not received his confiscated wallet and keys back.  \n\nIn connection with the raid, several of the Plaintiffs were transported to the precinct, where they were held for hours, and then to central booking.
