The personnel included individual defendants Officer Peter Segerdahl and Sergeant Nicholas Kuliecza, along with John Doe 2 through 4. Plaintiffs were wearing completely different clothing from the description provided in the report. However, without probable cause or reasonable suspicion of any crime, they were ordered from the automobile, which was searched with their consent. The officers did not discover anything unlawful. Nonetheless, plaintiffs were arrested by the officers, one of whom appeared to be the supervisor, and taken to the 88th Precinct. \n\nThere, the officers prepared or allowed to be prepared false police reports of Plaintiffs drinking rum although they did not observe Plaintiffs with alcoholic beverages. Approximately six or seven hours later, Plaintiffs were taken to Brooklyn Central Booking to await arraignment. During that time, Officer Segerdahl made, and another defendant allowed him to make, false statements to the Kings County DA's Office, which caused Plaintiffs to be prosecuted on the false charge of consumption of alcohol in public. After approximately twenty-four hours in custody, Plaintiffs were arraigned on false charges, released, and required—under threat of issuance of an arrest warrant and of arrest—to appear in Criminal Court.
