Plaintiff was lawfully driving, when he became aware he was being pulled over by NYPD officers. Plaintiff pulled over. Defendants approached plaintiff’s vehicle on the driver side, and requested he provide his license and registration. Plaintiff requested to know why he was stopped, but did not refuse to provide the requested documentation. Plaintiff respectfully requested to speak to a supervising officer. Defendants advised plaintiff they would have a supervisor come to the scene. Multiple other officers arrived on the scene. Plaintiff began to speak with defendant Kovalenko and again requested to know why he was stopped. Kovalenko ordered plaintiff to exit the vehicle. Plaintiff exited the vehicle and handed Kovalenko his license and registration. Defendants placed plaintiff under arrest by handcuffing his arms tightly behind his back. Defendants searched plaintiff’s person and effects. Plaintiff was transported to a police precinct where he was searched, fingerprinted and charged with Obstructing Governmental Administration. Plaintiff was transported to Central Booking. Defendants filled out false police reports and forwarded them to prosecutors at the Bronx County DA. Plaintiff spent 24 hours in custody and made one court appearance.
