Plaintiff did not initially intervene but later facilitated the return of the items in a safe manner. Despite his actions, Defendant Tanner of the IAB initiated an investigation into Plaintiff. Plaintiff was wrongfully charged for simply and literally being present near others who had allegedly committed a crime involving the stealing of champagne bottles. The charges against Plaintiff were broadcasted in the news and DA's press release.
