CNC Wreckers had a contract to provide towing services to Pathmark Supermarket, 410 W. 207 St., NY, NY. Pathmark has a parking lot that permits only its customers to use the lot. The lot had visible signs indicating non-customers who parked their vehicles in the lot would have their vehicles towed. Plaintiff was notified by Pathmark asst mgr Jones there was a vehicle illegally parked in the lot. Jones directed Plaintiff to tow the vehicle and provided an authorization form to tow. Plaintiff towed the vehicle to the 34th precinct. The vehicle owner reported the car missing from the parking lot. Defendant Castro was assigned to investigate the missing vehicle, and spoke with Jones who said Plaintiff was given permission to tow the vehicle. Despite learning Jones gave Plaintiff permission to tow the vehicle, Plaintiff was handcuffed and arrested. Plaintiff was at the 34th precinct for several hours and denied access to water and bathrooms. Plaintiff was removed to the New York Booking for several hours. Plaintiff had no access to water or a working bathroom. On August 24, 2012, Plaintiff was arraigned and charged with Unauthorized Use of a Vehicle. Plaintiff was released on his own recognizance.
