The vehicle developed a flat tire and Joseph came to a stop. Joseph was then approached by Ruane, one of two motorcycle officers, who told him he had passed through a red light before stopping and asked for his driver's license. Joseph complied with the officer's directive without argument. Other officers were called to the scene. \nPlaintiff Gibbons was seated in the rear of the vehicle and to assist the officer's visibility, opened the door to the van so that Pacheco could see inside. Pacheco sprayed mace into the rear of the van, which hit directly into Gibbons's face. The spray also severely affected the other occupants. Gibbons exited the vehicle in an effort to breathe and was thrown to the ground and struck by numerous officers including Pacheco and McDonald. Gibbons was handcuffed, yet was also struck by officers. Gibbons did not resist in any manner. Pacheco falsely arrested Gibbons and swore to a Criminal Court Complaint charging him with disorderly conduct, obstructing governmental administration and resisting arrest. Charges were dismissed in court that evening. Plaintiffs Joseph, Gibbons, Pierre-Toussaint and Tatum all required medical attention at Kings County Hospital.
