Plaintiff chased after the van and attempted to speak with the driver at a red light. Plaintiff was unable to communicate with the driver since he did not respond in English.  As Plaintiff continued to chase after the van, Plaintiff noticed two Defendant Officers ahead and headed towards them. The driver of the van also approached the Defendant Officers. Plaintiff informed the Defendant Officers that his right arm was hit by the van and that he was willing to file a police report. Defendant Officer Victor Cruz responded by grabbing Plaintiff’s right arm. Plaintiff pleaded with the Defendant Officers. Plaintiff asked why defendants are stopping him when he was the one who asked for help. When it became clear that Defendant Officers were not going to assist Plaintiff in any way, he turned to walk away. As Plaintiff turned, Defendant Officer Victor Cruz and his partner both shot their tasers and hit Plaintiff in the back, causing Plaintiff to fall unaided onto the hard ground. Several more Defendant Officers arrived on scene and jumped on top of Plaintiff who was already incapacitated on the ground after having been tasered twice. Defendant Officers dug their knees into Plaintiff’s back as they handcuffed him. Defendant Officers lifted Plaintiff off the ground and placed him into a police vehicle and then transported him to the 44th precinct. Upon arrival at the precinct, Plaintiff was booked and illegally searched again. Defendant Officers, without cause, placed their hands inside Plaintiff’s pants and search around his genitals. After six hours spent in police custody, Plaintiff was released with a Desk Appearance Ticket. While Plaintiff was in custody, the defendant police officers provided the DA with the false, misleading and/or incomplete information that Plaintiff committed a crime.
