But he was pushed and punched by the police officers. The last plaintiff, Luz Cruz, is a writer and was at a van volunteering to deliver food in the area. The officer stopped, searched his van, and arrested Mx. Luz. Their request to lose the tight handcuff was ignored and confiscated their insulin and did not let them administer it resulting in missing a dose of it. He then required medical emergency room treatment where he was taken by an ambulance. Plaintiff Ashley Martinez was subsequently falsely and violently arrested without a warrant or probable cause and held at the precinct without access to a working bathroom for 5-6 hours. She was falsely charged with obstruction of governmental administration in the second degree despite the Defendant Officers knowledge that she had not committed this offense. DA declined to prosecute. \n\nBased off of Defendant officers’ action, Plaintiff was deprived of liberty, suffered emotional distress, pain, and humiliation, Plaintiff was unlawfully stopped and searched, falsely arrested, and subject to unreasonable force. When Plaintiffs continued to state there were not drugs in the home, the officers conducted an excessively destructive search of the home. Officers never found drugs in the apartment. After the search of the home, Officer Bennett took Plaintiff mother into her room and conducted an illegal strip search. Officer Bennett then repeated this with Plaintiff daughter. Plaintiffs were then taken out of the apartment and placed in an unmarked police van for 2 hours. Plaintiff mother was removed from the van and questioned about drugs again. When it yielded no result, Plaintiff mother was placed back inside the van.
