Plaintiff told the officers he was leaving a friend’s house in the building and gave them the address. Plaintiff also proffered his New York State ID card. Despite giving the officers all of his information, including who he was visiting with permission, he was placed under arrest for trespassing. Plaintiff was held for approximately 72 hours before he was released on his own recognizance after seeing a judge. Plaintiff made two subsequent court appearances before he received an ACD and all charges were eventually dropped. At no time did Plaintiff commit any crime. In addition to the unlawful arrest, Plaintiff was, inter alia, subject to excessive force and unwarranted and malicious criminal prosecution.
