Plaintiff had just been assaulted by a man with a handgun who struck Plaintiff in the head causing a readily apparent bleeding laceration to Plaintiff’s head when Defendants, approached, grabbed, searched, seized and arrested Plaintiff.\nPlaintiff was not committing and criminal acts, had just been the victim of a violent assault, and did not exhibit any indications of criminality. Defendants  illegally patted Plaintiff down and searched Plaintiff even though they had no reasonable suspicion, probable cause, consent or justification to do so. No contraband was recovered from Plaintiff’s person or in Plaintiff’s vicinity.  Defendants then violently contorted Plaintiff's hands and arms behind his back to which they affixed metal handcuffs in an excessively tight fashion which caused swelling, bruising and extreme pain. Plaintiff repeatedly requested that the defendants loosen the handcuffs but they refused. Defendants removed the Plaintiff to an NYPD precinct against his will, where the Defendants fingerprinted, photographed, searched and confined Plaintiff to a cell. Plaintiff was eventually transported to Central Booking where he remained until his arraignment. Defendant Medina signed or caused to be singed a criminal complaint against the Plaintiff that they knowingly affirmed the truth of the fabricated allegations against the Plaintiff that he was in possession of the firearm he was assaulted with.
