Plaintiff was lawfully present inside his house located at 126 Weirfield Street, County of Kings, NY.  On said date and time, Plaintiff was issued an order of protection from the family court in which Plaintiff shall not engage in any conversation with his son. Therefore, Plaintiff called the police for help with an intention to ask the son and son’s friend to leave the house. On said date and time, Plaintiff was sleeping in his house, bothered by his son and son’s friend who were smoking and was further not interfering with police activity in any way. Plaintiff asserts he was illegally targeted due to his race, color, ethnicity, or national origin. Defendants, including Apuango, John or Jane Doe 1-10, illegally approached, pushed, and assaulted and battered Plaintiff without probable cause.\n\nDefendants, including APUANGO , JOHN or JANE DOE 1-10 violently pushed Plaintiff back which come into forceful impact with Plaintiff’s chest and, further, causing Plaintiff to suffer substantial pain, significant injury to his arm, shoulders, chest, bruises, mental anguish, shock, and significant emotional distress. Defendants, including APUANGO , JOHN or JANE DOE 1-10, then illegally seized Plaintiff’s person with their outstretched hands aggressively grabbing him about his head and body before unlawfully searching his person by rifling their hands in and out of Plaintiff’s clothing and personal belongings.
