Ayme, Sergeant Mukhtarzada and P.O. John or Jane Doe 1-10 unlawfully stopped and questioned the Plaintiff, who had been present on a sidewalk, en route to attend a funeral. The Defendant officer illegally targeted the Plaintiff because of his race. The Plaintiff is a Black-Hispanic American male. The Defendant officers, without probable cause, grabbed and violently contorted the Plaintiff’s arms behind his back and applied handcuffs to his wrists in an excessively tight fashion. The Defendant officers ignored the Plaintiff’s complaints of the excessively tight handcuffs that were causing him to suffer substantial pain and discomfort. The Defendant officers illegally arrested the Plaintiff and transported the Plaintiff to the 34th NYPD precinct, where the Plaintiff was not informed of his rights under Miranda and was subjected to an illegal strip search. The Defendant officers falsely claimed that the Plaintiff had intentionally assaulted and injured other people even though the Plaintiff was not even at the location when said assault occurred. The Defendant officers fabricated non-existent evidence, suppressed exculpatory evidence, and initiated a malicious prosecution against the Plaintiff. The Plaintiff was later taken to New York County Central Booking, where he was wrongfully detained for three days.
