The defendants continued to apply pressure to Mr. Acosta's neck after he stated he could not breathe and applied tight handcuffs. Mr. Acosta was detained without being charged and, upon release, issued a summons which was then dismissed. \n\nPlaintiff Wanebo was \"singled out\" by NYPD Police Captain or Sergeant John Doe 1, and Officer Prince O’Connor then grabbed her. John Doe 1 then attempted to place Ms. Wanebo in a chokehold, causing injury to her shoulder, and then Officer O'Connor handcuffed her. She was then transported, detained unlawfully, and told that usage of her phone call would prolong her detention.
