Basora and other POs accused Plaintiff of lighting fireworks, despite the fact that the Plaintiff had at all times been inside his vehicle, the fireworks were clearly coming from other yards and Plaintiff was never, and was never observed, possessing or using fireworks. Upon exiting, Basora and other POs unlawfully arrested Plaintiff by having metal handcuffs affixed to his wrists in an excessively tight fashion and transported Plaintiff to the 45th Precinct, where he was criminally processed and detained for twelve hours. While at the precinct, Basora and other POs caused Plaintiff to be subject to a strip search despite having no reason to believe Plaintiff had any contraband and caused Plaintiff's vehicle to be illegally searched without a warrant or any other lawful justification. All charges against Plaintiff were dropped at a court appearance on August 14, 2019.\n\nThe above conduct represents a continuing pattern of harassment of Plaintiff based on his ethnicity by Basora and other 45th precinct POs. At the time, Plaintiff was doing electrical work in the basement. Despite lacking probable cause, the officers broke down the door and seized him, with one officer punching Plaintiff in the left temple after he was handcuffed. During the arrest, Plaintiff was not informed of the reason for his arrest and was taken to the 45th Precinct for processing. Defendant Basora was the arresting officer and signed the felony complaint. While in custody, Plaintiff requested medical attention for bleeding and bruises. Plaintiff was held in custody for approximately six days before being released.
