A language barrier made communications difficult, and Plaintiff Baez attempted to call her English-speaking niece. The officer snatched her phone. A neighbor who was observing the incident translated to Plaintiff Bez that they were asking for identification. Plaintiff Baez's purse was in the trunk, and the officer refused to let her retrieve it. The officer then searched the trunk, retrieved her purse and began emptying the contents of the purse onto Plaintiff Sierra Garcia. When Plaintiff Baez protested, the officer removed her from the car and threw her face down on the ground and put his knee on her back. Plaintiff Sierra Garcia protested her treatment and was removed from the car and handcuffed. Plaintiff Baez was yelling in protest and was subsequently maced. Plaintiff Sierra Garcia was then maced as well as he protested her treatment. The couple's niece approached the officers and was told to \"shut up\" and \"don't get any closer or you will be next.\" The Plaintiffs were then taken into custody, and Plaintiff Baez was ridiculed by officers who walked past, calling her \"whore and bitch.\" They were arraigned and charged with resisting arrest. After 24 hours in custody, they were released and went to the hospital for back pain from her handling by the officers. They also suffered effects from the mace on their eyes for several subsequent days.
