As Plaintiff approached the police and boyfriend on the street outside, he fled.  Defendant Officer Lyheem Oliver grabbed Plaintiff, falsely accused her of assisting with the escape, and twisting her arms placed tight cuffs on her.  Waiting for the officers to return, Defendant Oliver illegally attempted to access Plaintiff’s phone and made verbal threats.  The officers took Plaintiff to the 73rd Precinct where she was placed in an unsanitary cell lacking usable toilet facilities with a sick woman.  When Plaintiff stated she worked in another precinct as an auxiliary and that she knew that the 73rd Precinct officers were acting illegally, they charged her with pretending to be a police employee.  They also charged her with obstruction and other crimes.  Plaintiff was held for 48 hours before being released. The NYPD officers were looking for a previous resident of the apartment, plaintiff Wayne Millington, who plaintiff Vanessa Johnson did not know. While searching her apartment, defendant officers unlawfully handcuffed Ms. Johnson's two children. Plaintiff tried calling 911 to complain that her children were being handcuffed, but an officer seized her phone and told the operator that police were already at the scene. The officers conducted an unlawful search of plaintiff's phone and took photos of the contents of her phone. No contraband was found in the apartment, and the police ultimately uncuffed plaintiff's children and left without making any arrests. \n\nOn September 20, 2011, plaintiff Wayne Millington contacted the NYPD and inquired whether the NYPD was seeking to arrest him, which he was told that he was not wanted by the NYPD. However, on September 27, 2011, plaintiff Millington was arrested without probable cause.
