While Plaintiff was stopped at a red light, NYPD Officers Jeffrey Sanjuan, Gregory Santana, and Malcial Tuero blocked Plaintiff's motorcycle with an unmarked car. Officer Santana, wearing plainclothes, ordered Plaintiff off the bike without stating the basis for his stop. Plaintiff complied and asked why he was being stopped. Officer Santana insisted that Plaintiff had been seen with a pack of bikers performing \"wheelies\" on Broadway. Plaintiff truthfully denied doing wheelies or riding on Broadway at all. Officers Santana and Sanjuan decided to arrest Plaintiff without basis.\n\nOnce Plaintiff was at the precinct, either Sergeant Jose Ramos or Sergeant Daniel Gagliardi admitted that Plaintiff was not part of the pack of bikers he had seen, but still ordered the officers to keep Plaintiff under arrest and pursue charges against him. Sanjuan, Santana, Ramos, and Gagliardi concocted fake charges that Plaintiff had performed wheelies and driven without a motorcycle license. Plaintiff was then moved to Central Booking in lower Manhattan. He remained in custody until April 4 around 4 p.m., when he was arraigned and charged with three offenses (reckless endangerment, reckless driving, and unlicensed driving). Officer Sanjuan lied on the sworn criminal complaint, stating that he observed Plaintiff drive through multiple red lights, swerve through traffic, and perform a wheelie, all on streets Plaintiff never rode through. Plaintiff's case was dismissed due to failure to prosecute after Plaintiff returned to criminal court on five occasions.
