Plaintiff was at least 30 feet away from the arrest and was not interfering with it in any way. At some point, some of the NYPD officers including Offier Bulzomi approached Plaintiff and proceeded to aggressively push him. When Plaintiff protested the manner in which he was being accosted and handled by the NYPD officers, they promptly unlawfully placed him under arrest. They searched Plaintiff and found nothing illegal. Plaintiff was taken to the 75th precinct and then to Central Booking. At approximately 5:00 p.m., Plaintiff was arraigned before a judge on the charges of Criminal Possession of a Weapon in the Fourth Degree and Disorderly Conduct. The complaint included a sworn statement by Officer Bulzomi which was a total fabrication. Plaintiff pleaded “not guilty” and was released upon his own recognizance.
