A TOYS \"R\" US Market Investigator and/or Regional Asset Protection Manager questioned Plaintiff at the Bronx store about alleged \"push out\" activity (allowing customers to exit the store without paying for items) that occurred at the store. Plaintiff denied the allegations. She was then escorted out of the store, handed over to Det. Rogers, who was waiting outside with Det. Anthony Elio, placed her under arrest and taken to the 45th Precinct. Plaintiff was shown a written statement implicating her in an alleged \"theft ring\" and interrogated by Detectives Rogers and Maria Mundo. Plaintiff stood by her denial. After a couple hours, she was taken to Bronx Central Booking for photographs and fingerprinting. Around 9 p.m. on December 30, 2013, she released without charges. Detectives Rogers, Elio and Mundo were previously advised to not arrest Lyons as part of the \"theft ring\" investigation. Days after her release, Plaintiff was given a December 30, 2013 Bronx District Attorney's Office Affidavit in Support of Declining / Deferring Prosecution pending a full investigation by Toys-R-Us and receipt of evidence for review. The Affidavit also stated that no corroborating evidence had been received from the co-conspirator who was arrested on December 26, 2013. As such, Detective Rogers was instructed to not arrest any additional persons and the Toys-R-Us representatives were told to provide the DA with evidence.
