Defendants, without probable cause or legal justification, then ordered everyone in the vehicle to exit. Plaintiff repeatedly asked officers why they stopped him and why they wanted him to exit the vehicle but they refused to answer. Defendants then, without probable cause or legal justification, handcuffed and arrested Plaintiff. Defendants then seized the vehicle, drove it back to the precinct, conducted a warrantless search, and falsely alleged they recovered marijuana. Plaintiff was required to return to court five times before all charges against Plaintiff were dismissed and sealed on March 11, 2021. \n\nPrior to this incident, Defendants had pulled Plaintiff over twice without legal basis to stop him and unlawfully searched him. Both time they released him without ticketing him or charging him with a crime. \n\nDefendant Police Officer Christopher Francis has numerous allegations of misconduct made against him, some of which are pending discipline. There is also a Facebook page set up about Officer Francis by community members who post about incidents with him due to his known behavior of targeting and harassing Black men. Defendant Police Officer Delinda Giraldo also has history of suspension. Defendants, without probable cause or legal justification, ordered everyone in the vehicle, including Plaintiff, to exit.
