Defendant officers, including officers Charles Arnone (Shield No. 00408), Michael Gonzalez (Shield No. 05947) and Triston Trunk (Shield No. 03628), presented themselves at the residence on the basis of conducting a search of Ellington's residence pursuant to the terms of Ellington's parole. Ellington was was seized by defendants and placed into parole cuffs in an excessively tight fashion. Defendants then illegally stopped, seized, and detained Plaintiff-Perry and other lawful residents within the premises. Subsequently, defendants performed an unlawful search in an invasive and destructive manner, before allegedly recovering contraband from a safe located therein. Defendant-officers then seized plaintiffs Ellington and Perry, placed each plaintiff in excessively tightened handcuffs, and ignored plaintiffs' requests to loosen said handcuffs. Plaintiffs were arrested, processed, arraigned and subsequently remanded to Rikers Island Correctional Facility.  Defendant-officers maintained their misrepresentations to further the arrest, detention, and prosecution of the plaintiffs. Plaintiffs were targeted solely on their status as African American/Black or Hispanic/Latino males. \n\nAt Rikers Island Correctional Facility, both plaintiffs were subject to numerous batteries by other inmates or correction officers.  On January 26, 2022, plaintiff-Perry was released from physical custody.  On September 1, 2022, all adverse charges pertaining to Plaintiff-Perry were dismissed and sealed on the merits. On December 22, 2022, plaintiff-Ellington was released from physical custody.
